Introduction<\/strong><\/h2>\n\n\n\n<p>CheckinOnline360 is a digital service designed to help tourist accommodations comply with their legal obligations to register guests in compliance with the <strong>Royal Decree 933\/2021, of November 2, 2011.<\/strong>.<br>This policy transparently details how we process personal data, under what legal basis, who is responsible in each case, and what rights the data subjects have.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Identity and responsibility<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Responsible for the treatment (clients):<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Name:<\/strong> Xavi Hidalgo<\/li>\n\n\n\n<li><strong>TAX ID:<\/strong> XXXXXXX<\/li>\n\n\n\n<li><strong>Address:<\/strong> Carretera engolaster, 20 1\u00ba 3\u00aa - Escaldes de Engordany (Andorra)<\/li>\n\n\n\n<li><strong>Contact us:<\/strong> <a href=\"mailto:privacidad@checkinonline360.com\" target=\"_blank\" rel=\"noreferrer noopener\">privacidad@checkinonline360.com<\/a><\/li>\n<\/ul>\n\n\n\n<p><strong>Xavi Hidalgo<\/strong>as the CheckinOnline360 service provider, acts as a <strong>person in charge of the treatment<\/strong> with respect to the <strong>customer data<\/strong> (accommodation owners or managers), insofar as they decide on the purposes and means of processing related to the provision of the service (invoicing, support, account management, etc.).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Treatment manager (guests):<\/strong><\/h3>\n\n\n\n<p>With respect to the <strong>guest data<\/strong>, <strong>Xavi Hidalgo acts as data processor.<\/strong>since <strong>the accommodation (client) is, by law, responsible for the registration of its guests<\/strong> (Art. 4.1 of RD 933\/2021).<\/p>\n\n\n\n<p>Therefore:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>customer<\/strong> (accommodation) is responsible for ensuring the accuracy, legality and legitimacy of the collection of data from its guests.<\/li>\n\n\n\n<li><strong>CheckinOnline360<\/strong> only treats such data <strong>on behalf of and under instructions from the customer<\/strong>by means of a <strong>Data Processor Agreement<\/strong> implied or expressed when using the platform.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. Data processed and purposes<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>A. The treatment is <strong>exclusively instrumental and legal<\/strong>.<\/p>\n<\/blockquote>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. Conservation periods<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Clients:<\/strong>\n<ul class=\"wp-block-list\">\n<li>For the duration of the contractual relationship.<\/li>\n\n\n\n<li>After discharge: <strong>5 years<\/strong> for invoicing (mercantile obligation), and until <strong>10 years<\/strong> if there is pending litigation.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Guests:<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>3 years<\/strong> from the date of departure, in accordance with Art. 9 of RD 933\/2021 (custody period of the parts).<\/li>\n\n\n\n<li><strong>Document images:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Face-to-face check-in: eliminated <strong>immediately<\/strong> after data extraction.<\/li>\n\n\n\n<li>Online check-in: stored <strong>maximum 3 calendar days<\/strong>unless the company is eliminated early.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. Data recipients<\/strong><\/h2>\n\n\n\n<p>The data is communicated only in the following cases:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>To the State Security Forces and Corps<\/strong>as required by RD 933\/2021 and the applicable regional regulations.<\/li>\n\n\n\n<li><strong>To technical suppliers<\/strong> (hosting, payment gateways, support):\n<ul class=\"wp-block-list\">\n<li>All are linked by <strong>processing assignment clauses<\/strong>.<\/li>\n\n\n\n<li>They do not perform treatments outside the instructions received.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>To the client (accommodation)<\/strong>:\n<ul class=\"wp-block-list\">\n<li>Guest data and copies of the reports are sent to the lodging email for legal custody.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<p><strong>No data is disclosed to third parties for advertising or credit purposes or outside the European Economic Area.<\/strong>except in compliance with a court order.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6. Obligations and responsibilities<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>From the client (accommodation):<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It is <strong>legally responsible<\/strong> of the treatment of the data of its guests.<\/li>\n\n\n\n<li>You must inform guests of the collection of their data (usually by means of a sign at reception or a link to the check-in form).<\/li>\n\n\n\n<li>You must ensure that the data entered are <strong>accurate and truthful<\/strong>.<\/li>\n\n\n\n<li>You must ensure that the use of CheckinOnline360 complies with the applicable regulations.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>From CheckinOnline360 (Xavi Hidalgo):<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Processes guest data <strong>exclusively at the customer's expense<\/strong> and under his instructions.<\/li>\n\n\n\n<li>Implements <strong>technical and organizational security measures<\/strong> (encryption, restricted access, audits).<\/li>\n\n\n\n<li>Notifies the customer of any <strong>security breach<\/strong> affecting guest data within the legal deadline (72 hours if there is a risk to rights).<\/li>\n\n\n\n<li>Collaborates with the customer in the exercise of guests' rights (access, rectification, deletion), <strong>provided that the customer is liable as the responsible party<\/strong>.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>7. Rights of the interested parties<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Clients:<\/strong><\/h3>\n\n\n\n<p>You can exercise your rights of access, rectification, deletion, limitation, opposition, portability and withdrawal of consent by writing to <strong><a href=\"mailto:privacidad@checkinonline360.com\" target=\"_blank\" rel=\"noreferrer noopener\">privacidad@checkinonline360.com <\/a><\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Guests:<\/strong><\/h3>\n\n\n\n<p>You should address your requests to <strong>directly to the accommodation (customer)<\/strong>as it is the <strong>person in charge of the treatment<\/strong>.<br>CheckinOnline360, as manager, <strong>will collaborate with housing<\/strong> to meet your request, but <strong>does not answer directly to you<\/strong> unless expressly instructed by the person in charge.<\/p>\n\n\n\n<p>In all cases:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No charges are applied, except for repetitive or unfounded requests.<\/li>\n\n\n\n<li>We may request proof of identity to ensure confidentiality.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>8. Policy changes<\/strong><\/h2>\n\n\n\n<p>This policy may be updated to adapt to legal changes or service improvements.
