Purpose and Scope of Application<\/h3>\n\n\n\n<p>These Terms and Conditions (hereinafter referred to as the <strong>\"Terms\"<\/strong>) regulate the access and use of the website, the mobile application and any other digital platforms owned by <strong>chekinonline360<\/strong> (hereinafter, <strong>\"the Company\"<\/strong>) through which services are provided for the management, automation and digitalization of the online check-in process, transmission of data to competent authorities and other associated functionalities (hereinafter, the <strong>\"Service\"<\/strong>).<\/p>\n\n\n\n<p>By accessing, browsing or using any of the platforms of chekinonline360 implies full and unreserved acceptance of these Terms.<\/p>\n\n\n\n<p>If you do not agree to the Terms, you should refrain from accessing or using the Service.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>2. Condition of the Parties<\/strong><\/p>\n\n\n\n<p>For data protection purposes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>user who is the owner of the accommodation<\/strong> acts as <strong>Responsible for the treatment<\/strong>.<\/li>\n\n\n\n<li>chekinonline360 acts as <strong>Data Processor<\/strong>in the terms provided in the RGPD and the LOPDGDD.<\/li>\n<\/ul>\n\n\n\n<p>Acceptance of these Terms incorporates the <strong>Processing Assignment Contract<\/strong>unless a specific one is formalized between the parties.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>3. General Rules of Use<\/strong><\/p>\n\n\n\n<p>The user agrees to use the Service in accordance with the law, good faith, public order and these Terms. In particular, it is prohibited:<\/p>\n\n\n\n<p>a) Use the Service for unlawful or unauthorized purposes.<br>b) Transmit viruses, malware or any code of a destructive nature.<br>c) Simulating or manipulating reservations or housing units to avoid the actual contracting of the required number of units.<br>d) Accessing or attempting to access restricted areas without authorization.<br>e) Use the Service to obtain information from third parties without consent.<\/p>\n\n\n\n<p>Failure to comply with these obligations shall entitle the Company to suspend or terminate the user's account with immediate effect, without prejudice to further legal action.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>4. License of Use and Intellectual Property<\/strong><\/p>\n\n\n\n<p>chekinonline360 grants the user a <strong>limited, non-exclusive, non-sublicensable, non-sublicensable, revocable license<\/strong> to use the Service solely for the purpose indicated.<\/p>\n\n\n\n<p>All intellectual and industrial property rights over the platform, its source code, designs, contents, documentation and manuals belong to the Company or its licensors.<br>Any form of reproduction, distribution, transformation or public communication is prohibited without express written authorization.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>5. Service Information and Content Accuracy<\/strong><\/p>\n\n\n\n<p>The Company uses reasonable efforts to keep the information on the website up to date and accurate. However, <strong>does not guarantee the accuracy, completeness or currency<\/strong> of such information, which is provided for informational purposes only.<\/p>\n\n\n\n<p>The contents may include typographical errors or historical information. By entering a valid payment method, the user authorizes the Company to make the corresponding recurring charges.<\/p>\n\n\n\n<p><strong>No right of withdrawal<\/strong><\/p>\n\n\n\n<p>Pursuant to art. 103.m) RDL 1\/2007 and art. 16 LSSI-CE, the right of withdrawal does not apply once the Service has been provided.<\/p>\n\n\n\n<p><strong>Cancellation<\/strong><\/p>\n\n\n\n<p>The cancellation must be made <strong>before the renewal date<\/strong>.<br>Amounts already charged are non-refundable, except:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>fraudulent use of the means of payment,<\/li>\n\n\n\n<li>technical failures attributable to the Company that prevent cancellations, duly accredited.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>8. Obligations of the User in Data Protection Matters<\/strong><\/p>\n\n\n\n<p>The user -as Data Controller- shall:<\/p>\n\n\n\n<p>a) Provide its guests with a privacy policy in accordance with the RGPD.<br>b) Inform them that chekinonline360 acts as Data Processor.<br>c) Ensure that the collection of personal data complies with the regulations in force.<br>d) Ensure that the information transmitted to the competent authorities is correct and complete.<br>e) Proper configuration of the panel services, especially police integrations.<\/p>\n\n\n\n<p>If you do not have your own privacy policy, you may use the template provided by chekinonline360.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>9. Use of Cookies<\/strong><\/p>\n\n\n\n<p>The website uses its own and third-party cookies for technical, statistical and advertising purposes, always with the user's consent.<br>Details can be found in the corresponding Cookie Policy.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>10. Third Party Tools<\/strong><\/p>\n\n\n\n<p>The Service may integrate third party tools or links.<br>The Company does not guarantee its availability and is not responsible for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>damages resulting from access to third party platforms,<\/li>\n\n\n\n<li>the legality or accuracy of its contents,<\/li>\n\n\n\n<li>malfunctions or unavailability.<\/li>\n<\/ul>\n\n\n\n<p>The user must evaluate and use such resources at his\/her own risk.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>11. Advertising in the Check-in Process<\/strong><\/p>\n\n\n\n<p>The user accepts that the platform may display third-party advertising during the check-in process, managed by the Company, without using the guest's personal data for profiling purposes.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>12. Limitation of Liability of chekinonline360<\/strong><\/p>\n\n\n\n<p>To the fullest extent permitted by law, the Company shall only be liable for the <strong>direct damages<\/strong> resulting from proven non-compliance with its contractual obligations.<\/p>\n\n\n\n<p>In no event shall it be liable for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>indirect or consequential damages or loss of profits;<\/li>\n\n\n\n<li>loss of data not attributable to gross negligence of the Company;<\/li>\n\n\n\n<li>service interruptions beyond its control;<\/li>\n\n\n\n<li>misuse of the Service by the User;<\/li>\n\n\n\n<li>failure to comply with legal obligations of the user, especially in terms of identification and registration of guests;<\/li>\n\n\n\n<li>penalties imposed by authorities due to user-supplied data errors or incorrect platform configurations.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>13. Operational Liability Clauses (reinforced)<\/strong><\/p>\n\n\n\n<p>These clauses are incorporated in their entirety as an essential part of the Terms.<\/p>\n\n\n\n<p><strong>13.1 Data Accuracy<\/strong><\/p>\n\n\n\n<p>The end user is solely responsible for ensuring that the data entered in the platform are <strong>truthful, complete and in accordance with the law.<\/strong>.<br>The Company is not liable for penalties resulting from erroneous or omitted data.<\/p>\n\n\n\n<p><strong>13.2 Use of Electronic Signature<\/strong><\/p>\n\n\n\n<p>The user must select the type of signature allowed by his local regulations.<br>If a signature is rejected by the competent authority, the responsibility will be exclusively that of the user.<\/p>\n\n\n\n<p><strong>13.3 Transmission of Data to Authorities<\/strong><\/p>\n\n\n\n<p>The platform has automatic tools for sending travelers' reports and police data, but:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the user must verify its operation,<\/li>\n\n\n\n<li>confirm that the data is transmitted on time,<\/li>\n\n\n\n<li>review official acknowledgements of receipt.<\/li>\n<\/ul>\n\n\n\n<p>The Company is not responsible for penalties for late, incomplete or failed shipments resulting from incorrect user settings.<\/p>\n\n\n\n<p><strong>13.4 Service Connection and Configuration<\/strong><\/p>\n\n\n\n<p>The correct activation and maintenance of police or administrative integrations is the responsibility of the user.<br>Failures resulting from deactivations, incorrect passwords or non-enabled configurations will not be attributable to the Company.<\/p>\n\n\n\n<p><strong>13.5 Nature of Service<\/strong><\/p>\n\n\n\n<p>chekinonline360 is a <strong>automation software<\/strong>not a legal advisor.<br>The Company does not guarantee full compliance with the user's legal obligations.<\/p>\n\n\n\n<p>It is recommended that you obtain your own legal advice.<\/p>\n\n\n\n<p><strong>13.6 Changes in Service<\/strong><\/p>\n\n\n\n<p>The Company may make technical modifications without prior notice.<br>The user should review the changes to ensure continued legal compliance.<\/p>\n\n\n\n<p><strong>13.7 Final Validation of Information<\/strong><\/p>\n\n\n\n<p>The user is responsible for reviewing and validating all information processed or stored on the platform.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>14. Indemnity<\/strong><\/p>\n\n\n\n<p>The user shall hold the Company harmless against claims, penalties, damages or costs (including legal fees) arising from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>breaches of these Terms,<\/li>\n\n\n\n<li>infringement of third party rights,<\/li>\n\n\n\n<li>non-compliance with the user's own legal obligations.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>15. Divisibility<\/strong><\/p>\n\n\n\n<p>If any clause is deemed invalid or unenforceable, it shall be severed from the remaining clauses, which shall remain in force.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>16. Legislation and Jurisdiction<\/strong><\/p>\n\n\n\n<p>These Terms shall be governed by Spanish law.<br>Any dispute shall be submitted to the Courts and Tribunals of the city where the Company has its registered office, except in the case of mandatory regulations to the contrary.<\/p>\n\n\n\n<p>Notifications: <strong>privacidad@chekinonline360.com<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>17.
